CHAPTER 93.

CHAP. 94.

An act to allow Samnel Miller late Collector of Cecil Coun-
ty, further time to complete his collections.

10, 1843.

Be it enacted by the General Assembly of Maryland,
That Samuel Miller late collector of Cecil County, is here-
by authorised and empowered to collect any balance of
taxes that may be due the said Samuel Miller, in the same
manner and with the same power and privileges as are al-

lowed by law; provided, that if any person, against whom
there is a claim by said Miller for taxes as aforesaid, shall
make affidavit before any justice of the peace of said coun-
ty, that the same has been paid, the said Miller shall not
be authorised to collect the same by execution in the man-
«er now prescribed by law, but the said affidavit shall not
bar the said Miller's right to collect the said taxes as small
. debts are now recovered by law.

CHAPTER 94.

 

An act for the benefit of the heirs of Robert McCleary,
deceased.

Passed Jan.
17, 1843.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Catharine McCleary, natural guardian of
David, Ann, Maria and Catharine McCleary, infants, or un-
der twenty-one years of age, be, and she is hereby autho-
rized, to unite with the other heirs of the late Robert Mc-
Cleary, now of lawful age, to make a lease or leases for
the benefit of the heirs of the said McCleary, of a lot of
ground No. 235, lying in the town of Cumberland, to which
they are entitled as heirs of the said McCleary, for any
term or terms not exceeding nine years, at which time the
youngest of said children will be twenty-one years of age.

SEC. 2. And be it enacted, That it shall and may be law-
ful for the said Catharine McCleary on the part of said in-
fants, and the heirs of lawful age, to stipulate with the les-
sees for the free and unobstructed removal by them at the
expiration of their respective terms, of all improvements

erected by them on the premises leased; provided, all arrears
of rent shall have been previously paid to the person or
persons authorized to receive the same, and that the premi-
ses be left by the lessees in equally good condition as when
leased to them.
