CHAPTER 67.

CHAP. 68.

An act to protect the Herring and Shad Fisheries on the
Potomac River and Chesapeake Bay.

Passed Feb.
10, 1843.

Be it enacted by the General Assembly of Maryland,
That from and alter the passage of this act, it shall not be
lawful for any person or persons whatsoever, other than re-
sident citizens of this State, to fix, set or stake out any sort
of gill-nets, either stationary or floating, or any device what-
ever for the taking of herrings and shad in the Chesapeake
bay, or in the Potomac river, al any place on said bay or
on said river, within the jurisdiction of this State, from the
first day of March, the first day of June, in each and every
year; and any person or persons offending against the pro-
visions of this act for each and every offence committed,
shall be liable to a line of fifty dollars, and shall also forfeit
the vessel together with the whole of the tackle and appa-
rel, and all the lishing apparatus thereunto belonging, which
may bo used for the purpose of fishing, one half the fine,
together with all the gill-nets, other devices or instruments
for taking lish so used, for the use of the informer, and the
residue thereof together with the vessel so used and all her
tackle and apparel for the use of this State, to be recovered
by information and warrant before a justice in the county
most contiguous to the place where the offence may be
committed, who shall have full power and authority to en-
force the recovery and collection of the same.

CHAPTER 68,

 

An act for the benefit of George W. Morgan, late Sheriff
of Saint Mary's county.

Passed Feb.
11, 1843.

Be it enacted by the General Assembly of Maryland,
That the commissioners of the tax for Saint Mary's county,
are hereby authorized to levy upon the said county, and pay
to the said George W. Morgan, such sum of money as they
may think proper as a compensation to the said George W.
Morgan, for the expense of providing and keeping a pri-
vate jail, during the period of his Sheriffalty, the public
jail of said county being insecure.
