SEC. 3. And be it enacted. That all fines which shall or
may accrue to the said company, in consequence of delin-
quencies or mal-conduct of any member or members, shall
be sued for and recovered in the same manner as other
small debts are now collected.

CHAP. 61.

To be reco-
vered as other
small debts.

SEC. 4. And be it enacted, That nothing herein contained
shall be so construed as to authorize or empower said cor-
poration to issue any note, certificate, token or evidence of
debt to be issued as a currency; and the right is hereby ex-
pressly reserved to the General Assembly of Maryland, at
its pleasure, to alter, amend or annul this act of incorpora-
tion.

CHAPTER 61.

 

An act for the protection of Water-fowl on the Potomac
River.

Passed Feb. 1,
1843.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act, no
person, except citizens of this State, shall at any place
within the waters of the Potomac river, below the line of
the District of Columbia, or any of the creeks or branches
connected with said river, below said line, and within the
jurisdiction of this State, shoot at, or shoot any duck or
ducks from any vessel, boat, float, canoe or other draft of any
kind whatever, and any person so offending, shall be deem-
ed guilty of a misdemeanor, and upon conviction shall be
fined not less than twenty dollars for each and every offence,
and his boat, canoe, float or other vessel, so used, and his
guns shall be forfeited and be sold for the use of the State,

and stand committed until said fine be paid, provided, that
this act shall not extend to any person or persons owning
property on the Potomac river, or its tributary streams be-
low said line; all fines imposed by virtue of this act, shall
go one half thereof to the State, and the other half to the
person or persons apprehending the offender or offenders.

Proviso.

SEC. 2. And be it enacted, That all persons offending
against the provisions of this act, shall be proceeded against
before a single magistrate, a magistrate's court or by indict-
ment in the county court as for other misdemeanors, and
may be apprehended on the warrant of a Justice of the
Peace, and held to bail for his appearance before the. coun-
ty court, a single magistrate or a magistrate's court, as other
recognizances are now taken; and if any person is seen in
any of the waters aforesaid, in any boat, craft, canoe, float
