SEC. 4. And be it enacted, That nothing in this act be con-
strued, so as to authorise the said corporation to issue any

SEC. 5. And be it enacted, That this act of incorporation
shall endure for thirty years, from its passage, and that the
legislature reserves to itself the right to alter or annul this
act of incorporation at pleasure.

An act to make valid a certain deed of Mortgage therein
mentioned.
|

WHEREAS a deed of mortgage was heretofore made and
executed by a certain Josiah W. S. Heath, of Oktib-
beha county, in the state of Mississippi, conveying a cer-
tain lot of ground and premises, lying and being in Snow
Hill, in Worcester county, known on the plat of said town
as lot number forty, to a certain Robert M. R Smith, and
certain John W. Smith of said county; and whereas, the
said deed of mortgage is defective in its execution, by rea-
son of the acknowledgment of the same being made before
a clerk of a court of probate, instead of being acknow-
ledged before a judge of the court of record, and in conse-
quence of the said acknowledgment not containing a certi-
ficate of the identity of the party grantor: — Therefore,

Be it enacted by the General Assembly of Maryland,
That the said deed of mortgage from Josiah W. S. Heath,
of Oktibbeha county, and state of Mississippi, bearing
date on or about the fifteenth day of February, in the year
eighteen hundred and thirty nine, and duly recorded amongst
the land records of Worcester county, be and the same is
hereby declared valid, in the same manner as if the said
deed of mortgage had been duly executed and acknow-
ledged according to law, provided that nothing in this act
shall be construed to interfere with the rights of judgment
creditors or bona fide purchasers without notice.
