Philip Fletcher, have petitioned to make a navagable stream
of Town Creek, in Allegany county, which they represent
as attainable for use during the whole year, except in the
winter season, when closed by ice, the stream being con-
stant at all seasons; and whereas, they believe it would pro-
duce great benefits to that neighbourhood as it is found to
be rich in coal and iron, and will greatly add to the particular
interest of that locality, and the county generally, and with
no loss, hinderance or injury to anyone—therefore.

Section 1. Be it enacted by the General Assembly of
Maryland, That it shall and may be lawful for any three
of the petitioners named in the memorial praying to obtain
this act, to call a meeting to take into consideration the best
means of raising a capital to effect the making of said lock
and dam navigation, beginning for the same at the Chesa-
peake and Ohio Canal, and to continue from thence as far
up the said creek as may be found practicable and expedi-
ent; and provided, the parties owning the land through
which the said Town Creek passes, and is to be made navi-
gable, shall assent thereto.

Sec. 2. And be it enacted, That so soon as the said
petitioners meet, anil resolve to carry into effect the said
lock and dam navigation from the canal upwards, it shall
and may be lawful to form a company with a capital not
exceeding fifty thousand dollars, to make and carry into ef-
fect the said lock and dam navigation, and to open a book
for the receiving and entering subscriptions to the said un-
dertaking, to be called the Lock and Dam Navigation Com-
pany of Town Creek, to the extent of fifty thousand dol-
lars an aforesaid, in live hundred shares of one hundred
dollars each, under the management of three persons to be
named by the said petitioners or a majority of them, who
shall meet, after giving thirty days notice of the time and
place for such meeting, in two newspapers of the city of
Baltimore, and one in the town of Cumberland, and when
met, shall open books for subscription as aforesaid, and
keep the said books open for one or more days as they may
deem necessary, and the paid petitioners, or other persons
that may be appointed by the said petitioners or a majority
of them, may from time to time, on giving thirty days no-
tice as aforesaid, again meet in the said town of Cumber-
land, and open the said books for further subscriptions, un-
til the said capital of fifty thousand dollars shall be sub-
scribed, but so soon as the said company shall obtain sub-
scriptions to the extent of ten thousand dollars, the subscri-
bers to the stock of the said company, may give notice for
thirty days in three papers as aforesaid, that an election
will be held on a given day, to elect officers to the said
company as hereinafter directed by this act.
