CHAPTER 185.

Passed March
2, 1842.

A supplement to an act entitled, an act to abolish Magis-
trates Courts in Montgomery County., and to extend \the
jurisdiction of single Justices of the Peace in said coun-
ty, passed March session, eighteen hundred and forty-one,
chapter thirty-three.

Proviso

Section !. Be it enacted by the General Assembly of
Maryland, That in all cases where an appeal may have
been taken from the judgment of the magistrates courts,
under the provisions of the act to which this is a supple-
ment, that the bond filed in the clerks office, in such case
or cases, shall stay execution until the case or cases shall
be determined by the county court; provided, the clerk of
Montgomery county will approve of the sufficiency of said
bond or bonds.

Sec. 2. And be it further enacted, That it shall be the
duty of the clerk of said court when required of, to exam-
ine said bonds, and endorse his approval or dissent.

Right to a-
mend petition

Sec. 3. And be it enacted, That an appellant may file
his petition upon an appeal to said county court at any time
before the trial of the cause, and also have the right to
amend His or her petition, subject to such terms as the said,
court may in its discretion impose.

 

CHAPTER 186.

Passed March
2, 1842.

An additional supplement to an act entitled, an act to regu-
laic sales by Public Auction, passed at December session,
eighteen hundred and twenty-seven, chapter one hundred
and eleven.

Repealed.

Section 1. Be it enacted by the General Assembly of
Maryland, That so much of the first section of the act, to
which this is a supplement, as limits the duty on sales made
at auction, to one dollar in the hundred on said sales, be and

the same is hereby repealed.
Sec. 2. And be it enacted, That from and after the first
day of April next, the rale of duty shall be one dollar and
fifty cents in the hundred, on all sales made by any individ-
ual, firm or association, or by any agent of such individual,
firm or association, as shall take out a license to sell by auc-
tion, in the manner prescribed in the act to which this is; a
