claim in dispute be made against the executor or adminis-
trator, or by the executor or administrator—therefore,
Section 1. Be it enacted by the General Assembly of
Maryland, That the orphans court shall have power,
where an executor or administrator, as such, shall have
any claim or claims, against any person or persons, with the
consent of both parties, to be entered on their proceedings,
to arbitrate between such executor or administrator and
such person or persons, against whom such executor or ad-
ministrator may have any claim or claims, or the dispute
may, by the parties, be referred to any person or persons,

Sec. 2. And be it enacted. That the provisions which
at the death of any testator, testatrix or intestate, shall have
been laid up for the consumption of his or her family, shall
not be sold by the executor or administrator, but shall re-

Sec. 3. And be it enacted, That any live stock which
shall be necessary for the use of the Family, may also be
killed for their use at any time before a sale of the estate
and the orphans court shall in the settlement of the account

her or their credit for such articles as may have been used
as aforesaid, provided, in the opinion of the said orphan
