CHAP.

To make affi-
davit.

18. Sec. 2. And be it enacted, That the said Benjamin T.
Pindell, shall in every instance, before ho shall proceed to
the aforesaid collection, make affidavit, before some justice
of the peace for Anne Arundel county, that the same re-
mains unpaid, and that he hath not received any security or
satisfaction for the same, or any part thereof, more than the
credits allowed thereon.

Limit.

Sec. 3. And be it enacted, That this act shall not con-
tinue in force longer than one year from the date of the
passage thereof.

 

CHAPTER 18.

Passed Jan.
19, 1842.

An act to prohibit the sale of Ardent Spirits, within one
mile of the Alms House, of Anne Arundel County.

Sale of spiri-
tous liquors
forbid.

Section 1. Be it enacted by the General Assembly of
Maryland, That, from and after the first day of April,
eighteen hundred and forty-two, it shall not be lawful for
any person or persons, to sell any distilled or fermented
liquors within one mile of the Alms house., in Anne Arundel
county, and any person or persons so offending, shall be lia-
ble to indictment in the county court of said county, and
upon conviction thereof, such person or persons shall be
sentenced to pay not less than the sum of five dollars, at
the discretion of said court; nor shall the clerk of Anne

license.

Arundel county grant any license for the sale of ardent
spirits or fermented liquors to any person or persons with-
in that distance of said Alms house.

Penalty for
violating

Sec. 2. And be it enacted, That if any person or persons
shall, after the passage of this act, without the consent in
writing first had of the trustees or overseer of the Alms
house, sell any distilled or fermented liquors, or exchange
the same for any commodity whatever, to any pauper resid-
ing in, or staying at the Alms house of said county, such
person shall upon conviction thereof, to be subject to a fine
not less than five dollars, at the discretion of the court,
for every such offence, and forfeit his, or their license.
