act, the said commissioners, or a majority of them, shall
adjudge and determine in the matter, according to their
sense of right, justice and propriety; and if said commis-
sioners, or any of them, shall wilfully disregard such ap-
peal, or act corruptly and oppressively, they or he shall be
personally liable for all damages sustained by the party ag-
grieved, to be recovered in an action on the case at the suit
of such party; and for the purpose of hearing and deter-
mining all appeals provided for in this act, the said com-
missioners or a majority of them, may appoint such time
and times of meeting as they nifty think proper, of which
the usual public notices shall be given.

CHAP. 103.

Shall appoint
meetings.

SEC. 10. And be it enacted, That in the event of the death
of either or both of the persons aforenamed as assessors,
or in the case of the removal of either or both from said
county, or of the refusal of either or both to act, the clerk
of Allegany county may appoint some other suitable person
or persons to fill such vacancy or vacancies, or any future
vacancy or vacancies, should any in like manner occur, and
the person or persons so appointed, shall perform all the
duty or duties, or any remaining duty or duties of assessor
under this act, as fully as though he or they had been ori-
ginally appointed by this act; and should any person whom
the aforenamed assessors, or their substitutes, associate to
themselves in each district as hereinbefore provided for,
die, refuse or become disqualified to act, said assessors may
appoint another, whenever the vacancy occurs, to perform
and fulfil all or any remaining duties of such associate.

SEC. 11. And be it enacted, That the several assessors ap-
pointed and chosen under or by virtue of this act, shall re-
ceive such compensation for their services as the commis-
sioners of said county shall think reasonable and proper,
according to the duty which said assessors shall respect-
ively perform; which said compensation shall be levied and
collected as other county charges are.

SEC. 12. And be it enacted, That the commissioners of
said county shall, at their first levy term after the final com-
pletion of the assessment and valuation made by virtue of
this act, proceed to levy the taxation on the said new as-
sessment and valuation as the circumstances of the county
may require.

SEC. 13. And be it enacted, That if the assessment and
valuation contemplated by this act, can be completed in
time for the next levy term of the said county commission-
ers, that nothing in this act contained shall be so construed
as to prevent the said commissioners from levying the taxes
at said term upon said new assessment and valuation.
