CHAP. 94.

Incorporated.

Name.
Legal capacity.

Allegany County School, and having all the powers prescri-
bed in the fourth, fifth, and sixth sections of said act, of
seventeen hundred and ninety-eight, are hereby declared to
be one community, corporation and body politic, to have
continuance forever, by the name of the Frostburg Acade-
my, and by that name to sue and be sued, implead and be
impleaded, and to make and have a common seal, and the
same to break, alter or renew, when and so often as they
may think fit.

Authority to
build academy.

SEC. 2. And be it enacted, That the persons named in
the first section of this act, shall have power to build said
Academy, out of the money so paid over to them, upon such
plan and dimensions as to them may seem right and proper.

Bond required.

SEC. 3. And be it enacted, That the persons named in
the first section of this act, shall, before the receipt of the
said money, give bond to the State of Maryland, condition-
ed for the faithful application of the same, and a compli-
ance with the requirements of the original act and this the
supplement thereto.

Apply residue
of money.

SEC. 4. And be it enacted, That the residue of the money
raised by virtue of the original act to which this is a supple-
ment, be by the commissioners therein named, paid over to
the corporation of the town of Cumberland, to be by
the mayor and council of said town, applied to the erection
of said Market House and Town Hall, and for that purpose
said corporation shall be, and are hereby authorised to pur-
chase land sufficient for the purpose named, the deed for
the same to be made to the mayor and council of the town
of Cumberland, for the use and benefit of the citizens thereof.

Inconsistent
acts repealed.

SEC. 7. And be it enacted, That all such parts of said
original act, as arc inconsistent with the provisions of this
act, be and the same are hereby repealed.

CHAPTER 94.

Passed Jan. 30,
1841.

A supplement to an act, entitled an act to abolish Magis-
trates Courts in Allegany County, and to extend the
jurisdiction of single Justices of the Peace in said Coun-
ty, passed December session, eighteen hundred and thir-
ty-nine, chapter seventy-seven.

Preamble.

WHEREAS, no provision is made in the act to which this
is a supplement, to authorise the closing of judgments ren-
