1841.

LAWS OF MARYLAND.

CHAP. 9.

Jr. and Edward Sturgeon, are hereby appointed commis-
sioners to lay out and open a road, not exceeding thirty feet
in width, from the public house of John J. Heckart to in-
tersect the public road leading from Perryville to Port De-
posit, near Gurleytown, in Cecil county.

Levy authorised.

SEC. 2. And be it enacted, That the commissioners of
Cecil county are hereby authorised and empowered, at their
discretion, on receiving from said road commissioners, or
a majority of them, an account, on oath, of the expenses of
surveying, laying out and opening said road, including two
dollars per day to the road commissioners for their services,
to levy the same at their next annual levy, provided the
sum does not exceed one hundred dollars on the assessable
property of said county, to be collected as other county
charges are now collected.

Shall ascertain
damages.

SEC. 3. And be it enacted, That the aforementioned com-
missioners shall value and ascertain the damages that may
be sustained by any person or persons through whose land
the said road may be made to pass; and that the damages so
ascertained, shall be levied, assessed and collected as other
county charges now are; and that in estimating the amount
of damages, the advantages of said road shall be taken in-
to consideration.

And make out
plat.

SEC. 4. And be it enacted, That the said commissioners
shall cause to be made out a plat of the said road, which
plat shall be returned by them to the clerk of Cecil county;
to be recorded among the records of said county.

Oath of office.

SEC. 5. And be it enacted, That the said commissioners,
before they proceed to act, shall take an oath or affirma-
tion before some justice of the peace, that they will, with-
out favor, partiality or prejudice, assess the damages sus-
tained by the person or pet-sons through whose land the said
road may pass, if said persons shall claim damages.

CHAPTER 9.

Passed Mar. 29,
1841.

A further supplement to the act to incorporate the Upper
Marlbro' Academy, passed at December session, eighteen
hundred and thirty-five, chapter two hundred and four.

Preamble.

WHEREAS, the trustees of Upper Marlbro' Academy are
willing that the buildings of the said academy shall be used
and occupied as a free school, on condition that they are
paid such sum therefor as would be necessarily expended
