CHAP. 5.
|
John Shaw, are hereby appointed commissioners, to survey,
lay out and open a road, not exceeding thirty feet in width,
from the public road leading from Carpenter's point to
Charlestown, to intersect the public road; leading from Per-
ryville to Elkton, in Cecil county.

Levy authorised.
|
SEC. 2. And be it enacted, That the commissioners of Ce-
cil county, are hereby authorised and empowered, at their
discretion, on receiving from said road commissioners, or a
majority of them, an account, on oath, of the expenses of
surveying, laying out and opening said road, including two
dollars per day to the road commissioners, for their
services, to levy the same at their next annual levy, provi-
ded the sum does not exceed one hundred and fifty dollars,
on the assessable property of said county, to be collected
as other county charges are now collected.

Ascertain da-
mages.
How paid.
|
SEC. 3. And be it enacted, That the aforementioned
commissioners shall value and ascertain the damages that
may be sustained by any person or persons, through whose
land the said road may be made to pass; and that the dama-
ges so ascertained, shall be levied, assessed and collected
as other county charges now are; and that in estimating the
amount of damages, the advantages of said road shall be
taken into consideration.

To make out a
plat.
|
SEC. 4. And be it enacted, That the said commissioners
shall cause to be made out, a plat of the said road, which
plat shall be returned by them to the clerk of Cecil coun-
ty, to be recorded among the records of said county.

Oath of office.
|
SEC. 5. And be it enacted, That the said commissioners,
before they proceed to act, shall take an oath or affirmation
before some justice of the peace, that they will, without
favor, partiality or prejudice, assess the damages sustained
by the person or persons through whose land the same may
pass, if said person shall claim damages.

County, to levy a sum of money for the use of Thomas
Grimes.

|
Be it enacted by the General Assembly of Maryland,
That the levy court of Prince George's county, be and
they are hereby authorised and directed, at their next levy-
ing day, to adjust and settle the claim of Thomas Grimes,
