1841.

An act to incorporate a Company to make a Turnpike Road
from Middletown, in Frederick County, to the Chesa-
peake and Ohio Canal, at some point thereon in the Ca-
toctin Valley, between the Catoctin and Blue Ridge
Mountains.

Incorporated.

Road described.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That a company be, and the same is hereby in-
corporated for making a turnpike road from Middletown,
in Frederick county, to the Chesapeake and Ohio Canal, at
some point thereon in the Catoctin valley, between the Ca-
toctin and Blue Ridge mountains, along such route as they
may determine is best suited for the purpose, and that the
company may use the bed of the roads now leading from
Middletown to either Jefferson or Knoxville, or any part
or parts of said roads, or any other road or part or parts
of any other road or roads, and any bridge or bridges erect-
ed upon any of said roads or road, as they may find neces-
sary, by and with the consent in writing, of a majority of
the levy court of Frederick county, at any one of their
stated meetings.

gers.

SEC. 2. And be it enacted, That the president and managers
of the said company may agree with the owners of lands
for the purchase of lands required for said road, and also
for the purchase of stone, gravel, earth and sand for said
road; and in all cases where they are unable to agree with
the owners or the owner, or the owner should be a feme
covert, non compos mentis, or under age, the said president
may apply to a justice of the peace for the county afore-
said, which justice shall thereupon issue his warrant to the
sheriff of said county, commanding him to summon twenty
disinterested men qualified to act as jurors in the county
court, to meet upon the land, and after four are stricken off
the pannel by the president or his agent, and four by the
person or persons interested, in his, her or their absence or
refusal, by the sheriff, the said sheriff shall qualify the re-
maining twelve jurors, either by oath affirmation, (as the
case may be) justly, truly and impartially to value the da-
mages which may be sustained by the owner or owners of
