for a public or county wharf; and that the said levy court
shall levy and pay over to the said Thomas H. Clagett such
sum of money as said commissioners, or a majority of them,
shall award by way of damages; and the said wharf shall
ever thereafter be taken and considered as a public or coun-
ty wharf, to be kept up at the public charge.

CHAP. 144.

Award of da-
mages.

SEC. 3. And be it enacted, That, the road from Green
Landing, until it intersects the road from Upper Marlbro'
to Queen Anne, be and the same is hereby declared to be
a public highway; and the levy court of said county are
hereby authorised and required to cause the same to be
kept in repair as other county roads are now provided for
by law.

lic highway.

An act to authorise Charles County Court to issue a com-
mission for the division of the Real Estate of Francis
W. Hawkins and Jane L. Hawkins, deceased.

Passed Feb. 26,
1841.

WHEREAS, Francis W. Hawkins, and Jane L. Hawkins,
his wife, late of Charles county, deceased, died leaving the
following heirs at law, to wit: Josias Hawkins, Theophilus
Hawkins, Luke W. B. Hawkins, Susanna Jane Weems, and
Mary Hawkins; and the said Francis W. Hawkins and
Jane L. Hawkins having both left real estate; and whereas,
the said Susanna Jane Weems is deceased, leaving the fol-
lowing minor children, to wit: John Weems, Francis W.
Weems and Thomas Mathews, all which minor children
are represented by John Mathews, their guardian; and
whereas, from the position, nature and character of the land-
ed property of the said Francis W. Hawkins and Jane L.
Hawkins, and from doubts entertained as to the effect and
construction of their respective wills, it has been deemed
prudent, and for the interest of all concerned, so far as the
heirs at law and devisees of said Francis W. Hawkins and
Jane L. Hawkins are interested, to treat the estates of the
said Francis and Jane as one estate — therefore,

Preamble.

Be it enacted by the General Assembly of Maryland,
That Charles county court shall have power, authority and
jurisdiction to issue a commission in conformity with the act
to direct descents, to partition and divide the real estate of
the said Francis W. Hawkins and Jane L. Hawkins, as if
the whole of said real estate belonged to either the said
