(House Bill 593)

AN ACT to repeal and re-enact, with amendments, Section
179 (a) of the Anne Arundel County Code (1947 Edition,
being Article 2 of the Code of Public Local Laws of Mary-
land), title "Anne Arundel County", sub-title "Budget De-
partment", sub-heading "Expenditures", authorizing the
County Commissioners of Anne Arundel County to appro-
priate the surplus in any year for capital improvements.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 179 (a) of the Anne Arundel County Code
(1947 Edition, being Article 2 of the Code of Public Local
Laws of Maryland), title "Anne Arundel County", sub-title
"Budget Department", sub-heading "Expenditures", be and
it is hereby repealed and re-enacted, with amendments, to
read as follows:

179. (a) In case the general revenues of the County from
taxes and all other sources (except those covered by sub-sec-
tion (b) hereof) exceed the amounts appropriated therefrom
in the budget and expended during the fiscal year, such sur-
plus may be appropriated by the County Commissioners in
any year for capital improvements as defined in Section
167 (c), but if not so appropriated shall constitute a part of
the general revenue for the ensuing fiscal year.

SEC. 2. And be it further enacted. That this Act shall take
effect June 1, 1949.
