CHAPTER 374
(House Bill 471)

AN ACT to repeal and re-enact, with amendments, Section
1191 of the Montgomery County Code (1947 Edition), be-
ing Section 1297 of the Prince George's County Code (1943
Edition), being also Article 16 and 17 of the Code of
Public Local Laws of Maryland (1930 Edition), title
"Montgomery County", sub-title "Takoma Park", sub-head-
ing "Mayor and Council", relating to the time of meeting
of the Council and eliminating obsolete provisions relating
to the power of the Mayor to act as a Justice of the
Peace.

SECTION 1. Be It enacted by the General Assembly of Mary-
land, That Section 1191 of the Montgomery County Code
(1947 Edition), being Section 1297 of the Prince George's
County Code (1943 Edition), being also Articles 16 and 17
of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Montgomery County", sub-title "Takoma Park",
sub-heading "Mayor and Council", be and it is hereby re-
pealed and re-enacted, with amendments, to read as follows:

1191. (1297) (a) The Council shall meet at some con-
venient place in said city on or before the fourth Monday
in April next succeeding their election, and as often there-
after as may be necessary to discharge the duties of their
office; not less, however, than once in every month. A ma-
jority of the Council shall constitute a quorum for the trans-
action of business and the Council shall pass rules and by-laws
for their own government while in session; upon a tie vote
the vote of the Mayor shall be deciding;; in the absence of the
Mayor at any meeting the members of the Council present
shall elect one of their own number to preside during his
absence who, for the time being shall be clothed with all the
powers and authority of the Mayor.

(b) The Mayor, as executive officer of the City, shall be
charged with enforcement of the laws and ordinances of the
municipality; he shall annually appoint such standing com-
mittees and from time to time such special committees as
the Council may determine and shall designate the chairman
and the members thereof and may change such chairman or
members as his judgment may determine; he shall have
general supervision of the administration and officers of the
city and for reasons to him good and sufficient may suspend
any officer from duty, setting forth the reasons for such
suspension to the Council for its action, not later than its
