ballots be destroyed at any time after the expiration of two
years from the election at which such ballots were cast.

(M) The Council shall within ten days after each election
determine all questions arising thereon; and any person con-
ceiving himself aggrieved by reason of such decision may
appeal to the Circuit Court of Montgomery County, or to
the Circuit Court of Prince George's County, depending upon
the place of residence of the appellant, which shall hear and
determine the same, and determine who shall pay the costs
of appeal. In case of a tie vote at any election for Mayor
and members of the Council, another election shall be held,
after ten day's notice, pursuant to the provisions foregoing
in regard to elections. In case of any vacancy in the office
of the Mayor or a Councilman by death, resignation or re-
moval from the city, the said vacancy shall be filled by a
vote of the Council until the next election for members of
the Council.

(1ST) The Mayor shall receive, in lieu of expenses, com-
pensation of $600. 00 per annum and each Councilman shall
receive, in lieu of expenses, compensation of $300. 00 per
annum, payable in equal monthly allotments; provided, how-
ever, that said compensation shall not be effective until
first submitted to the qualified voters of the City and ap-
proved by a majority of those voting thereon. At said elec-
tion there shall appear upon the ballot or upon the voting
machines if that be the manner of conducting the said elec-
tion the words "Shall the Mayor and Councilmen be com-
pensated at the rate of $600. 00 and $300. 00 each, per annum,
respectively, in lieu of expenses?" followed by the words
"yes" and "no", with a square after each; the voter, if paper
ballots are used, is to register his choice by making a cross
mark (X) in the square opposite the word expressing his
or her judgment; if voting machines are used, by registering
his judgment by operating said machines in such a manner
as to register thereon a "yes" or "no" vote on said proposal.
Should said proposal be approved by a majority of those
voting thereon at said election, said compensation shall be
effective on and after the first day of the month next follow-
ing said approval.

SEC. 2. And be it further enacted, That all acts and parts
of acts, laws and parts of laws, ordinances and parts of
ordinances, inconsistent herewith or contrary hereto, be,
and the same are hereby repealed to the extent of such in-
consistency.
