stealing, taking or carrying away any child under the age of
sixteen years, except by a parent thereof, shall be guilty of a
felony and shall be sentenced to death or to the penitentiary
for not more than thirty years, in the discretion of the Court.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.

CHAPTER 5

(House Bill 7)

AN ACT to repeal and re-enact, with amendments, Section
436A of Article 27 of the Annotated Code of Maryland
(1947 Supplement), title "Crimes and Punishments", sub-
title "Manslaughter, " providing for the offense of man-
slaughter by motor boat, and to repeal Section 108A of
Article 99 of the Annotated Code of Maryland (1947
Supp. ), title "Birds, Game and Inland Water Fish, " sub-
title "Regulations for Taking of Game and Fresh Water
Game Fish in Non-Tidal Waters, " said section relating to
manslaughter by motorboat on Deep Creek Lake.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 436A of Article 27 of the Annotated Code
of Maryland (1947 Supplement), title "Crimes and Punish-
ments, " sub-title "Manslaughter, " be and it is hereby repealed
and re-enacted, with amendments, to read as follows:

436A. Every person causing the death of another as the
result of the driving, operation or control of an automobile,
motor vehicle, motor boat, locomotive, engine, car, street car,
train or other vehicle in a grossly negligent manner, shall be
guilty of a misdemeanor to be known as "manslaughter by
automobile, motor vehicle, motor boat, locomotive, engine,
car, street car, train or other vehicles", and the person so
convicted shall be sentenced to jail or the House of Cor-
rection for not more than three years, or be fined not more
than $1, 000. 00 or be both fined and imprisoned. The Police
Magistrates of the City of Baltimore shall have the power
to accept bail for persons charged with the offense created
by this section.

In any indictment or warrant for manslaughter by auto-
mobile, motor vehicle, motor boat, locomotive, engine, car,
