under its seal to be a true copy and the whole of such ordi-
nance or record, shall be received in all Courts as presump-
tive legal evidence of the facts therein stated.

SEC. 31. That for the purpose of determining whether the
citizens of said proposed Town of Forest Heights desire to
incorporate, there shall be held a referendum election on the
third Tuesday in April 1949, under the supervision of the
committee hereinafter named, the manner and procedure of
which shall be as hereinafter provided. Should the citizens
of Forest Heights vote against incorporation at their elec-
tions, this act of incorporation may be resubmitted on the
third Tuesday in April of the two succeeding years, for their
approval or rejection.

The Committee to conduct such referendum elections shall
consist of T. Marl Hemphill, E. L. Dolecek, Alice Gerhart,
W. C. Hannemann, M. F. M. Osborne, W. K. Bice, William
Rowe, Jr., and if any of said Committee are unable or de-
cline to serve, the remaining members of said Committee are
empowered to select some resident of said proposed town to
fill his or her place. The Committee shall appoint two
Judges and two Clerks who shall conduct said election, and
any of said Committee are hereby authorized to act as Judges
or Clerks.

The qualification of voters in the referendum election shall
be the same as those hereinbefore set forth for general town
elections.

The said Committee shall provide and furnish a registration
book as hereinbefore provided for each ward, booths, ballot
boxes, tally sheets, printed ballots and the places of regis-
tration and election, and shall not later than the second
Wednesday in April, in the year of the election, post in five
conspicuous places in each ward in the said proposed town,
a typewritten or printed notice notifying all residents of the
proposed town that a referendum election will be held on the
date corresponding to the third Tuesday in April, in the year
of the election, between the hours of eleven o'clock A. M., and
eight o'clock P. M., at a place to be designated therein to de-
termine whether or not this Act incorporating the proposed
town shall become effective, and also notifying them of the
qualifications for voters, and that in order to vote for or
against incorporation, it will be necessary for all voters to
register before said Judges of Election on the second Friday
in April, in the year of the election, between the hours of
eleven o'clock A. M. and eight o'clock P. M., at a place to be
designated therein.

The said Judges of Election shall attend at said times and
place for registration and register all qualified persons who
