of this Act shall be held invalid or unconstitutional by any
court of competent jurisdiction, such invalidity or uncon-
stitutionality shall not affect the validity of the remaining
portions or sections of this Act. The General Assembly
hereby declares that it would have passed such other sec-
tions or parts of this Act if it had known that any such
section, word, phrase, clause, sentence or part would or
might be declared unconstitutional.

SECTION 3. And be it further enacted, that this Act
shall take effect June 1, 1949.

CHAPTER 124
(Senate Bill 337)

AN ACT to repeal and re-enact with amendments Sub-
sections (A) and (G) of Section 1000 of the Code of
Public Local Laws of Montgomery County (1947 Edi-
tion), Title: "Montgomery County", Sub-title: "Rock-
ville", being Article 16 of the Code of Public Local Laws
of Maryland, so as to specify more clearly how improve-
ments to be made under said Act may be initiated, the
type of public works which may be undertaken, and to
provide that the certificates of indebtedness issued to
finance any such improvements shall be payable from un-
limited ad valorem taxes to be levied by the Mayor and
Council of Rockville in the event the front foot assess-
ments therein provided for should at any time prove
insufficient for the purpose.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sub-sections (A) and (G) of Section 1000 of the
Code of Public Local Laws of Montgomery County (1947
Edition), Title: "Montgomery County", Sub-title: "Rock-
ville", being Article 16 of the Code of Public Local Laws
of Maryland, be and the same are hereby repealed and re-
enacted with amendments to read as follows:

1000. (A) The Council is authorized and empowered
whenever in its judgment, the public health, safety or
comfort requires it, to grade, construct, reconstruct, 1 pave
or otherwise improve any street, sidewalk, alley, curb,
curb and gutter and public highway, or parts thereof, at
such time and to such extent and of such materials and in
