HOUSE BILL No. 765
AN ACT to add a new sub-section to Section 25A, Article 66 1/2
of the Annotated Code of Maryland (1947 Supplement), title
"Motor Vehicles", sub-title "Administration—Registration—
Titling", said new sub-section to be known as Sub-section (e)
and to follow immediately after Sub-section (d) of said
Section 25A, relating to the payment of the titling tax on
motor vehicles which are warranty replacements of other
motor vehicles.
This Bill is intended to amend existing law to provide for
the waiving of the excise tax on motor vehicle titles where
warranty replacements are involved. I am informed that the
Attorney General, in construing Section 25A of Article 66 1/2 of
the Code, held that its provisions were inapplicable to certain
replacements which were made under a warranty. For that
reason, I think the amendment is unnecessary. In addition,
this Bill contains a provision for waiving the tax upon the
determination by the Commissioner of Motor Vehicles that the
original vehicle cannot be used upon the highways of this
State. I am not informed of any instance which has arisen
involving this particular aspect of the present Bill. However,
because of the Attorney General's construction of the law, it
seems to me that this amendment is unnecessary and I am,
therefore, vetoing the Bill.

SENATE BILLS Nos. 429 AND 430
AN ACT to repeal Sections 1, 2, 3 and 4 of Article 19A of the
Code of Public General Laws of Maryland (1939 Edition and
1947 Supplement), title "Conservation of Natural Re-
sources", sub-title "Board of Natural Resources", and to
enact in lieu thereof four new sections to be known as Sec-
tions 1, 2, 3 and 4 of said Article and said sub-title, relating
to the Board of Natural Resources, its composition, duties
and powers and the conservation and rehabilitation of nat-
ural resources in this State.
Senate Bill No. 429 provided for a reorganization of the
Commission of Tidewater Fisheries, an expanded program of
oyster propagation with the necessary authority, revenues and
appropriations to effect this expanded program. Senate Bill
No. 430, a companion measure, would reorganize the Board of
Natural Resources and vest in a director of that agency the
duty and power to coordinate, direct and supervise the opera-
tions of the State's departments dealing with natural resources.
