of this State. The secretary of the Commission shall receive
such salary as shall be provided in the State Budget and shall
be entitled to receive his actual and necessary traveling and
other necessary expenses incurred by him in the performance
of his official duties, payable out of said fees. The Commis-
sion shall annually make to the Governor a full report of
its proceedings for the year ending June 1st each year, and
may submit with such report such recommendations pertain-
ing to its affairs as to it shall seem desirable. At the time
of making said report said Commission shall transmit to the
Governor a full and detailed statement of all its receipts and
disbursements during the preceding year.

SEC. 2. And be it 'further enacted, That this Act shall take
effect June 1, 1949.

CHAPTER 18
(House Bill 42)

AN ACT to repeal and re-enact, with amendments, Section 5
of Article 93 of the Annotated Code of Maryland (1939
Edition), title "Testamentary Law", sub-title "Account",
increasing the amount which may be allowed as a pre-
ferred claim for funeral expenses.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 5 of Article 93 of the Annotated Code of
Maryland (1939 Edition), title "Testamentary Law", sub-
title "Account", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

5. On the other side shall be stated the disbursements
by him made, and which are to be made in the following
order and priority: First, funeral expenses, to be allowed
at the discretion of the court according to the condition
and circumstances of the deceased, not to exceed five hun-
dred dollars ($500. 00) except by special order of the
Court, and provided the estate of the decedent be sol-
vent; second, his allowance for costs and extraordinary ex-
penses (not personal) which the Court may think proper to
allow, laid out in the administration or distribution of the
estate or in the recovery or security of any part thereof, costs
to include reasonable fees for legal services rendered upon
any matter in connection with the administration or distribu-
