"Rights and Duties of Licensees", respectively, relating to
refund of license fees and transfer of licenses in case of
receivership, bankruptcy or assignment for the benefit of
creditors.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 52(a) (1) and 62(a) of Article 2B of the
Annotated Code of Maryland (1947 Supplement), title "Al-
coholic Beverages", sub-title "Procedure for Issue of Li-
censes", and "Rights and Duties of Licensees", respectively, be
and they are hereby repealed and re-enacted, with amend-
ments,, to read as follows:
52. (Refund of License Fees. ) (a) No holder of any class
of license shall be entitled to a refund of the unearned portion
of the fee paid for a license, upon the surrender thereof, ex-
cept:
(1) in the event of receivership or bankruptcy of the busi-
ness in the event a transfer is not requested, and in such
case the refund shall be made for the benefit of the creditors
of such licensee, or
62. (Transfer of Licenses. ) (a) Any holder of a license
under the provisions of this Article including a receiver or
trustee for the benefit of creditors, may be permitted to
transfer his place of business to some other location or sell
or assign said license and his stock in trade to another per-
son, provided that application for such transfer or sale shall
be made, and that a bulk sales permit is obtained where the
stock of alcoholic beverages is to be sold, and the new loca-
tion or assignee shall be approved as in the case of an origi-
nal application for such license. Such transfer or assign-
ment when made shall be endorsed upon the license by the
official issuing the same, upon the payment of a fee of One
Dollar ($1. 00) in addition to the costs of publication and
notice, which shall be paid at the time of the filing of the
application for the transfer or sale.
SEC. 2. And be it further enacted, That this Act shall take
effect June. 1, 1949.
