CHAPTER 738
(House Bill 522)

AN ACT to repeal and re-enact, with amendments, Section
7A of Article 41 of the Annotated Code of Maryland (1947
Supplement), title "Governor—Executive and Administra-
tive Departments", sub-title "General Provisions", provid-
ing that copies of certain rules and regulations be sub-
mitted to the Attorney General for approval and filed with
the Secretary of State and that said rules arid regulations
be published.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 7A of Article 41 of the Annotated Code of
Maryland (1947 Supplement), title "Governor—Executive and
Administrative Departments", sub-title "General Provisions",
be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

7A. (a) Prior to the adoption of any rule or regulation by
any officer or department of the executive branch of the State
of Maryland under any rule-making power granted by the
General Assembly of Maryland, the said rule or regulation
shall be submitted to the Attorney General of Maryland for
approval as to its legality. Every officer, department, board,
commission, bureau and similar agency of the State Govern-
ment other than those within the Legislative and Judiciary
Departments who has power to make, promulgate, adopt or
enforce rules and regulations shall file copies thereof with the
Clerk of the Court of Appeals, with the Secretary of State
and with the Department of Legislative Reference. No rule
or regulation hereafter made, promulgated or adopted shall be
effective until after compliance with this section. Any rule
or regulation, filed as required by this section, shall be ad-
missible as evidence in any court proceeding, upon certifica-
tion by the Clerk of the Court of Appeals. Nothing in this
section shall relieve any officer, board or commission of any
legal requirement as to the publication or other notice of the
adoption or promulgation of such rules and regulations.

(b) The Secretary of State shall cause all such rules and
regulations filed with him to be printed for distribution to the
several State departments, officers and commissions and for
sale to the members of the general public. Supplements to
such publication shall be issued from time to time as the
Secretary of State shall determine until such time as it seems
desirable to revise and publish all such rules and regulations
in one or more volumes.
