coning six months next preceding the election, and who shall
have been registered as hereinafter prescribed, shall on the
first Tuesday in May, 1949, and on the same day every
second year thereafter, at such place as the Mayor and
Councilmen may designate within the corporate limits, elect
one qualified voter of said town to be Mayor of Lonaconing,
who shall hold office for two years and until his successor
shall have qualified; and at the same time shall elect three
qualified voters of said town to be Councilmen for said town,
to serve four years, or until their respective successors shall
have qualified; and the Mayor and Councilmen shall quality
on or before the fourth Tuesday in May, and shall enter
upon their respective duties on the first Tuesday in June
of each year.
397. They shall in the month of June, 1949, and every
second year thereafter, appoint a bailiff who will be the
Chief of police officers in Lonaconing and such additional
police officers as they may deem necessary for the safety of
said town, who upon entering upon the duties of their office,
shall make oath before the Mayor that they will faithfully
perform all duties required of them as officers according to
the best of their skill, judgment and without favor, affection
or prejudice, and said bailiff and other police officers shall
give such bond and security for the faithful performance of
all duties imposed upon them as bailiff and police officers in
such sum as the Mayor and Councilmen may designate and
with such security as may be acceptable to the Mayor and
Councilmen; and the said bailiff and police officers may be
removed at any time by said Mayor and Councilmen for any
malfeasance, non-feasance or misfeasance of their respective
office. The qualifications for such bailiff and police officers
shall be such as may be determined by said Mayor and Coun-
cilmen.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
of the General Assembly of Maryland, the same shall take
effect from the date of its passage.
