Act that the said existing Civil Service Commission shall
become the Civil Service Commission established by this Act,
with the individual members thereof to have the tenure pro-
vided by their original appointments.
SEC. 4. And be it further enacted. That those employees in
the service of the City covered by civil service provisions
prior to the enactment of this Act shall be continued as a
part of the Classified Service established by this Act, in the
same or a comparable position. All future appointments to
the Classified Service shall be made as provided in this Act.
SEC. 5. And be it further enacted, That nothing in this Act
shall be construed as changing or interrupting the tenure of
the Mayor or of any Councilman. The Mayor and each
Councilman shall continue to have their respective titles, but
shall have only the powers, duties and responsibilities pro-
vided in this Act.
SEC. 6. And be it further enacted, That before this Act
shall become effective the question shall be submitted to the
qualified voters of the City at a special election to be pro-
vided for by the Board of Election Supervisors of Allegany
County on the first Tuesday in June, 1949. There shall be
placed on the official ballots, or on the voting machines if
such are used, the words "For New Charter" and the words
"Against New Charter", with suitable provision for the voter
to indicate his choice. If a majority of the qualified votes
cast on said question shall be cast "For New Charter" this
Act shall become effective on the first Tuesday in September,
1949. If a majority of the qualified votes cast on said ques-
tion shall be cast "Against New Charter", this Act shall not
become effective and shall be wholly null and void.
SEC. 7. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by
three-fifths of all of the members elected to each of the two
Houses of the General Assembly of Maryland, the same shall
take effect from the date of its passage.
