qualified certified public accountant appointed for that pur-
pose by the Mayor and City Council. The Board shall
furnish to the Mayor and City Council every six months a
statement showing the receipts, disbursements, and general
financial condition of the hospital.
CONDEMNATION
197. POWER. The Mayor and City Council shall have a
right to acquire privately-owned property for public use, by
condemnation, subject generally to the procedures established
in Article 33A of the Annotated Code of Maryland, title
"Eminent Domain. " The Mayor and City Council may con-
demn private property for the corporate purposes and powers
of the City, including, by way of enumeration and not limi-
tation, the construction or providing of sewers, drains, dis-
posal plants, water systems, water works, land, water and
water courses, rights of way, streets, alleys, sidewalks, public
parks, markets, and flood control.
SURETY BONDS
198. SURETY BONDS. All surety bonds required by this
Article shall be conditioned upon the faithful performance
of the duties of the office. They shall be subject to the
approval of the Mayor and City Council, and made payable
to the use of the Mayor and City Council, except that the
surety bonds given by the Mayor and by the members of the
City Council shall be subject to the approval of the State
Comptroller and shall be made payable to the use of the
State of Maryland. All surety bonds shall be with corporate
surety. The City shall pay the premiums on all surety bonds
required by this Article.
199. RECORDING. All surety bonds made payable to
the Mayor and City Council shall be recorded in the office
of the Clerk of the Circuit Court of Allegany County. A
certified copy of any such bond, under seal, shall be sufficient
evidence to prove the execution of such bond in any Court
in this State.
SUITS FOR DAMAGES
200. SUITS FOR DAMAGES, (a) The City shall not be
liable for damages of any kind unless the person injured, or
someone in his behalf, shall within ninety days after the
occurrence complained of notify the City Manager in writing
as to the facts of the occurrence, stating specifically when,
where and how the injury occurred, and the extent thereof.
