tion of any contract, and when making payments to the con-
tractor of moneys becoming due under said contract, to with-
hold and retain therefrom all sums and amounts which shall
have been forfeited pursuant to the hereinabove mentioned
stipulation and the terms of this sub-title; provided however,
that no sum shall be so withheld, retained or forfeited except
from the final payment, without a full investigation by said
Mayor and City Council or its officers and agents.

99. RECORDS. The contractor or sub-contractor shall
keep or cause to be kept an accurate record showing the
names and occupation of all laborers, workmen and me-
chanics employed by him in connection with the said public
work, and showing also the actual per diem wages paid to
each of such workers, which record shall be open at all rea-
sonable hours to the inspection of the Mayor and City Coun-
cil, its officers and agents.

100. PENALTY. Any officer, agent or representative of
the City who wilfully shall violate or omit to comply with
any of the provisions of this sub-title, and any contractor or
sub-contractor, or agent or representative thereof, doing
public work as aforesaid, who shall neglect to keep, or cause
to be kept, an accurate record of the names, occupation and
actual wages paid to each laborer, workman or mechanic em-
ployed by him in connection with said public work, or who
shall refuse to allow access to such records at any reasonable
hour to any person authorized to inspect them, shall be guilty
of a misdemeanor. Upon conviction thereof he shall be pun-
ished by a fine of not exceeding Five Hundred Dollars
($500. 00) or by imprisonment not exceeding six (6) months,
or by both fine and imprisonment, in the discretion of the
Court.

STREETS, ALLEYS AND SIDEWALKS

101. DEPARTMENT. The streets, alleys, and sidewalks
of the city shall be under the general. direction and supervi-
sion of the Department of Streets and Public Property, the
head of which shall be the City Engineer, a member of the
Classified Service of the City and a professional civil engi-
neer.

102. DUTIES, (a) The City Engineer, under the City
Manager, shall have general supervision and direction over
the construction of all culverts, bridges, drains, and water
system improvements projected by the Mayor and City
Council.
