in other States, whereby insane, lunatic or feeble-minded
persons who are being cared for at public expense in any
asylum or institution for the care of the insane in
this State (other than persons who shall have been trans-
ferred thereto from penal institutions, and the terms of
whose sentences to such penal institutions shall not have
expired), and who are citizens or residents of such other
States, may be transferred at the expense of this State to
similar institutions in such other States, and whereby in-
sane, lunatic or feeble-minded persons who are being cared
for at public expense in such asylums or institutions of other
States (other than persons who shall have been transferred
from penal institutions, and the terms of whose sentences
to such penal institutions shall not have expired) and who
are citizens or residents of this State, may be transferred
at the expense of such other States to similar institutions
in this State, provided that nothing in this section contained
shall prevent the Department of Welfare of Baltimore City
from making such arrangements for the return to other
places in the United States of insane persons found in Balti-
more City who are residents of such other places, and for the
return to Baltimore City of insane persons resident therein,
who may be found in other places in the United States, as
said Department of Welfare has made or may hereafter make
in accordance with regulations which said Department of
Welfare has heretofore adopted or which it may hereafter
adopt.

SEC. 2. And be it further enacted, That Sections 15 and 20
of said Article and title, sub-title "Board of Mental Hygiene",
be and the same are hereby repealed and said sub-title be
and the same is hereby repealed, and that in lieu of said
Sections and sub-title so repealed, there be and are hereby
enacted two new sections to be known as Sections 15 and 20
and a new sub-title to be known as "Department of Mental
Hygiene", to read as follows:

DEPARTMENT OF MENTAL HYGIENE

15. (a) The Board of Mental Hygiene is hereby abolished.
There shall be a Department of Mental Hygiene under the
direction of the Commissioner of Mental Hygiene, with full
power and authority to supervise, direct and control all
State institutions caring for or treating persons of unsound
mind and with such other rights, powers, duties, obligations
and functions as are now or hereafter may be conferred upon
the Department or the Commissioner by law.
