known as Section 372 and to follow immediately after
Section 371 of said Article, providing for the distribu-
tion of income accruing from date of death of testator
under certain conditions.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new section be and it is hereby added to Article
93 of the Annotated Code of Maryland (1939 Edition),
title "Testamentary Law", sub-title "Wills", said new
section to be known as Section 372 to follow immediately
after Section 371 of said Article, and to read as follows:
372. Unless otherwise expressly provided by the will
of a person dying after the effective date of this Act, all
net income from real and personal property, accruing from
the date of the death of the testator, and not payable
under the will to others as otherwise disposed of, shall be
distributed as income to those persons who are entitled
under the will to the income from the residuary estate in
the proportions to which they are so entitled. Unless
otherwise expressly provided by the will, none of such
income shall be added to the corpus of the residuary estate,
the whole or any part of which is devised or bequeathed
in trust for life or for a term of years, but shall be dis-
tributed pro rata as income to the beneficiaries of a trust
of any part or all of the residuary estate, to any tenants
for life or for a term of years and to any persons entitled
absolutely and free of trust to any portion of the residuary
. estate. Nothing contained in this Act shall affect the right
to income of any legatee or devisee who would otherwise
be entitled to such income from property devised or be-
queathed to him.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1949.
