sion, be and the same is hereby created with the powers
and duties hereinafter set forth:

(A) The Commission hereby created shall consist of
five members, residents and taxpayers of Salisbury, and
Fred A. Grier, Jr., Henry W. Roberts, John E. Morris,
George P. Chandler and Avery W. Hall are hereby
appointed to serve as the Commission and they shall elect
one of their members to serve as Chairman of the said
Commission. Upon the completion of the projects con-
templated by this Act, all duties and powers of the Com-
mission hereby created shall cease, and all authority and
power invested in it, and all duties imposed upon it by this
Act, shall then vest in and devolve upon The Mayor and
Council of Salisbury.

(B) Any member of said Commission may at any
time resign by tendering his resignation in writing to the
Mayor of Salisbury, and any vacancy in said Commission
occasioned by the resignation, death or incapacity of the
incumbent shall be filled by The Mayor and Council of
Salisbury upon recommendation made by the Commission.
In case all the members of said Commission shall resign
at the same time, then all the vacancies thereto shall be
filled by the Mayor of Salisbury, subject to confirmation
by the Council of Salisbury.

(C) The Commission is hereby appointed to expend the
proceeds from the bonds authorized to be issued by this
Act for the purposes specified in this Act. Said Commis-
sion is hereby authorized and empowered to construct,
establish, design, extend and operate during construction
a sewage treatment plant, sanitary sewerage system, in-
cluding sewer trunk lines, force mains, lateral sewers,
intercepting sewers, pumping stations, and a garbage incin-
erator plant and necessary appurtenances thereto within
Wicomico County and shall have authority to acquire in
the name of The Mayor and Council of Salisbury by gift,
purchase, lease, or otherwise all lands, either in fee or as
an easement, improvements, water courses and water
rights necessary therefor. Whenever resort shall be had
to acquisition by condemnation the proceedings shall be
instituted and prosecuted upon the order of the Commis-
sion by The Mayor and Council of Salisbury under Article
33A, title "Eminent Domain", of the Annotated Code of
Maryland, Edition of 1939, and all amendments thereto.

(D) The said Commission shall cause surveys, studies,
plans, specifications and estimates to be made for the es-
tablishment and construction of a sewage treatment plant,
