CHAPTER 475
(Senate Bill 399)

AN ACT to repeal and re-enact, with amendments, Section
22 of Article 89B of the Annotated Code of Maryland
1947 Supplement), title "State Roads, " and to add a new
section to Article 66 1/2 of the Annotated Code of Mary-
land (1947 Supplement), title "Motor Vehicles, " sub-
title "Operation of Vehicles Upon Highways, " to be
known as Section 197A, and to follow immediately after
Section 197 of said Article, relating to damage or injury
to highways and roadbeds, constructed or being con-
structed or new repairs thereto, or parking strips or
center parkway area and other matters relating to the
protection of the State Highway System, and providing
penalties for violation of said new section.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 22 of Article 89B of the Annotated Code of
Maryland (1947 Supplement), title "State Roads, " be
and it is hereby repealed and re-enacted, with amendments,
to read as follows:

22. The members of the State Roads Commission, and
such of its employees and servants, as are designated by
it, shall have authority to enforce all laws of this State
relating to State Highways and the provisions of the
motor vehicle laws applicable to the size and weight of
motor vehicles, and to arrest all violators of any of the
provisions of law in reference to State Highways and the
use of said Highways by motor vehicles as aforesaid or
violators of the regulations and orders of the State Roads
Commission in relation thereto. Every such employee or
servant shall, when exercising any such authority here-
under, wear and display a metallic shield or badge indi-
cating that he is an employee or servant of the State Roads
Commission of Maryland; provided, however, that no con-
tractor, his employee or servant shall be permitted under
this section to make any arrest.

SEC. 2. And be it further enacted, That a new section
be and the same is hereby added to Article 66 1/2 of the
Annotated Code of Maryland (1947 Supplement), title
"Motor Vehicles, " sub-title "Operation of Vehicles Upon
Highways, " said section to be known as Section 197A, to
follow immediately after Section 197 of said sub-title, so
as to read as follows:

197A. Any person who shall ride, drive or walk upon
any new roadbed, or new repairs of any roadbed, con-
