73. Any person who shall intentionally or carelessly in-
jure any safety lamp, instrument, air course or brattice,
or without authority handle, remove or damage any fenc-
ing, means of signalling, apparatus or machinery, or shall
obstruct or throw open airways, or enter a place in or
about any mine against caution, or carry fire, open lights,
matches, pipes or other smokers' articles in gassy mines,
or open any door the opening of which is forbidden, or
disobey any order given in carrying out the provisions of
this sub-title or regulation pursuant thereto, or do any
other act whatsoever, whereby the lives or health of per-
sons employed or the security of the mine property is
endangered, shall be deemed guilty of a misdemeanor.

• 130. Whenever safety lamps are required to be used in
any mine, a quantity one-fourth larger than may be in
immediate use shall always be kept on hand, ready for use.
A competent person shall be appointed to examine every
such safety lamp immediately before it is taken into the
workings for use, who shall ascertain that such lamp is
clean, safe and secure before it is used.

131. No safety lamp shall be entrusted to any person
for use in a mine, until said person has given satisfactory
evidence to the mine foreman that he understands the
proper use, and the danger of tampering with the same.

133. The operator of every gassy mine shall employ a
sufficient number of fire bosses, each of whom shall satisfy
the operator of his competency, and shall have first ob-
tained a certificate of competency from the Examining
Board as hereinbefore provided.

SEC. 2. And be it further enacted, That Sections 77, 78,
88, 90-104, 110, 111, 114-119, inclusive, 138, 141, 142,
144-149, inclusive, of said Article, be and they are hereby
repealed, and that Sections 77, 78, 83, 90-104D, inclusive,
110, 111, 114-119, inclusive, 138, 138A, 141-142D, inclusive,
and 144-149C, inclusive, of said Article, be and they are
hereby enacted in lieu thereof, to read as follows:

77. Mine openings and escapeways. There shall be at
least two travelable passageways, to be designated as
escapeways, from each working section to the surface
whether the mine openings are shafts, slopes, or drifts.
They shall be kept in safe condition for travel and reason-
ably free from standing water and other obstructions. One
of the designated escapeways may be the haulage road,
provided, however, that one of the escapeways shall be
