SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1945.

CHAPTER 727.

(Senate Bill 574)

AN ACT to add a new section to Article 16 of the Anno-
tated Code of Maryland (1939 Edition), title "Chancery, "
sub-title "Trustee, " said new section to be known as
Section 279A, and to follow immediately after Section
279 of said Article, relating to the administration of
charitable trusts, devises or bequests, giving statutory
recognition to the doctrine of "Cy-Pres" in construing
charitable bequests, and making uniform the law with
reference thereto.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new section be and it is hereby added to Article
16 of the Annotated Code of Maryland (1939 Edition),
title "Chancery, " sub-title "Trustee, " said new section to
be known as Section 279A, to follow immediately after
Section 279 of said Article, and to read as follows:

279A. If a trust for charity is or becomes illegal, or
impossible or impracticable of enforcement or if a devise
or bequest for charity, at the time it was intended to be-
come effective, is illegal, or impossible or impracticable of
enforcement, and if the settlor, or testator, manifested a
general intention to devote the property to charity, a court
of equity may, on application of any trustee, or any in-
terested person, or the attorney general of the state, order
an administration of the trust, devise or bequest as nearly
as possible to fulfill the general charitable intention of the
settlor, or testator.

This section shall be so interpreted and construed as to
effectuate its general purpose to make uniform the law of
those states which enact it.

This section may be cited as the Uniform Charitable
Trusts Administration Act.

SEC. 2. And be it further enacted, That all acts or parts
of acts inconsistent with the provisions of this Act are
hereby repealed to the extent of such inconsistency.
