whether congenital or acquired by accident, injury, or disease
is, or may be expected to be, totally or partially incapicitated
for remunerative occupations; the term "vocational rehabilita-
tion" means the rendering of a disabled person fit to engage in
a remunerative occupation.
To be eligible for rehabilitation a person must have an em-
ployment handicap, and must be susceptible of rehabilitation.
267. The State of Maryland does hereby (1) accept the pro-
visions and benefits of the Act of Congress entitled "An Act to
provide for the promotion of vocational rehabilitation of per-
sons 'disabled in industry or otherwise and their return to
civil employment", approved June 2, 1920, as amended June 5,
1924, and July 6, 1943; (2) designate the State Treasurer as
custodian of all moneys received by the State from appropria-
tions made by the Congress of the United States for vocational
rehabilitation of persons disabled in industry or otherwise, and
authorize the State Treasurer, to make disbursements there-
from upon the order of the State Board of Education; (3) em-
power and direct the State Board of Education to cooperate
with the Office of Vocational Rehabilitation, in carrying out
the provisions of the Federal Civilian Vocational Rehabilita-
tion Act.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.

AN ACT to repeal and re-enact, with amendments, Section
33 of Article 77 of the Annotated Code of Maryland (1939
Edition), title "Public Education", sub-title "State Super-
intendent of Schools".

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 33 of Article 77 of the Annotated Code of
Maryland (1939 Edition), title "Public Education", sub-title
"State Superintendent of Schools", be and the same is hereby
repealed and re-enacted, with amendments, to read as follows:
