the number of certificates issued and the receipts and expenses
under this sub-title during each fiscal year.
70. (Revocation and Suspension of Certificates. ) The Com-
mission of State Forests and Parks, by majority vote thereof,
may permanently revoke or temporarily suspend any certifi-
cate of any Certified Tree Expert who has been guilty of any
fraud or deceit in obtaining such certificate, or who has been
guilty of negligence or wrongful conduct in the practice of
professional tree culture or care. The Commission may prom-
ulgate, and may amend, from time to time, rules of profes-
sional ethics and may temporarily suspend for a period not to
exceed two years the certificate of any Certified Tree Expert
who violates such rules of professional ethics, this power of
suspension being in addition to and not in limitation of the
power to revoke or suspend heretofore provided in this section.
No certificate issued under this sub-title shall be revoked or
the effect thereof suspended until the holder shall have had a
hearing before the Commission. Notice of the cause for sus-
pension or revocation under this section and the date of hear-
ing thereon by the Commission shall be mailed to the holder
of such certificate at his or her last known address at least
twenty days before said hearing. The non-appearance of the
holder of such certificate after notice as herein provided shall
not prevent such hearing. By majority vote the Commission
may re-issue any tree expert's certificate previously revoked.
Any person not a citizen of the United States when he or she
receives a certificate issued under this sub-title shall have such
certificate revoked unless within six years from the receipt
thereof he or she has become a citizen of the United States.
7. 1. (False Representations; Penalties. ) If any person shall
represent himself or herself to the public as having received
a certificate as provided for in this sub-title, or shall assume
to practice as a Certified Tree Expert without having received
such certificate, or if any person having received such certifi-
cate shall thereafter lose the same by revocation or have the
effect of the same suspended as provided for in this sub-title
and shall continue to practice as a Certified Tree Expert, or
if any person shall use such title, or the abbreviation "C. T. E. "
or any other words, letters, or abbreviations tending to indi-
cate that such person is a Certified Tree Expert without hav-
ing received such certificate or when such certificate has been
revoked or suspended, such person shall be deemed guilty of a
misdemeanor, and upon conviction thereof, shall be punished
for each offense by a fine not exceeding five hundred dollars
($500. 00) or by imprisonment not exceeding six months, or
by both fine and imprisonment, in the discretion of the Court.
Nothing in this sub-title shall be construed to prevent the
