Baltimore City on the basis of classroom units in opera-
tion, with certain limitations.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new Section be added to Article 77 of the Annotated
Code of Maryland (1939 Ed. ), title "Public Education, "
sub-title "Source and Distribution of Income, " to follow
immediately after Section 199 of said Article, and to be
known as Section 199A, said new Section to read as
follows:
199A. The Board of Education of each County and the
City of Baltimore shall be entitled to, and shall be paid,
each year in the manner and subject to the limitations
hereinafter provided, One Hundred Fifty Dollars ($150. 00)
or such sum in excess thereof as may be provided in the
budget, for each classroom unit in operation in such County
or City, respectively, for which a separate teacher is
employed, provided that the financial assistance herein
authorized shall not be available or given to any County
or to Baltimore City wherein any teacher receives a salary
lower than that established by Section 93 of this Article;
and provided further that if in any County or the City of
Baltimore the number of classroom units in operation shall
exceed the number of teachers required or permitted by
Sections 79, 189 and 229 of this Article, no classroom unit
in excess of the number of such teachers so required or
permitted shall be counted or used as a basis or measure of
the grant of financial assistance hereby authorized.
On or before the first day of October, January, March
and June, the State Superintendent of Schools shall certify
to the Comptroller one-fourth of the annual sum due the
County Board of Education of each County and of the
City of Baltimore hereunder, and thereupon the Comp-
troller shall draw his warrant on the Treasurer of the
State of Maryland for the respective amounts due to the
said Boards of Education, and the Treasurer of the State
of Maryland, upon receipt of said warrants shall imme-
diately pay the amount due on said dates to said respective
Boards of Education.
Provided, however, that the payments authorized herein
to be made for the next two fiscal years, beginning July 1,
1945 and July 1, 1946, respectively, shall be conditioned
upon the maintenance by the Counties and by the City of
Baltimore of not less than the amounts now being appro-
priated for school purposes, it being the intention that the
salaries of school teachers be not decreased during the
fiscal years above stated.
