operator thereof, shall, upon conviction, be subject to a
fine not exceeding $100. 00 or to imprisonment for not
more than thirty days, or both fine and imprisonment in
the discretion of the Court.
SEC. 2. And be it further enacted, That Section 256
of Article 56 of the Annotated Code of Maryland (1939
Ed. ), title "Licenses, " sub-title "Gasoline Tax, " be and
the same is hereby repealed, and that a new Section be
and it is hereby enacted in lieu thereof, said new Section
to be known as Section 256, to follow immediately after
Section 255 of said Article, as amended herein, and to read
as follows:
256. Upon compliance with the provisions of Section
255 of this Article, the Comptroller shall refund to the
United States of America and any of its agencies the tax
upon all motor vehicle fuel purchased by it or them. Fur-
thermore, the Comptroller is hereby authorized to approve,
in his discretion and subject to such regulations as he may
promulgate from time to time, in the cases of sales of
motor vehicle fuel to the United States of America or to
any of its agencies by dealers licensed under the provisions
of this sub-title, the non-inclusion of the tax in the price
charged for such fuel.
SEC. 3. And be it further enacted, That this Act is
hereby declared to be an emergency law and necessary for
the immediate preservation of the public health and safety,
and being passed upon a yea and nay vote, supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage.

AN ACT to repeal Sections 335 and 336 of Article 13 of the
Code of Public Local Laws of Maryland (1930 Edition),
title "Harford County, " sub-title "Havre de Grace, " re-
lating to the purchase or erection of a gas plant by the
City of Havre de Grace.
WHEREAS, the provisions of these sections are no longer
necessary; therefore
