CHAPTER 429.

(Senate Bill 461)

AN ACT to repeal and re-enact, with amendments, Sections
423 and 428 of Article 13 of the Code of Public Local
Laws of Maryland, title "Harford County, " sub-title
"Liquors and Intoxicating Drinks" (Higinbotham's 1942
Laws of Harford County; 421G and 421L of the Code)
providing the definition of the word "Restaurant, " and
providing for the forfeiture, after a conviction, for the
illegal sale or possession thereof, of intoxicating liquors
seized by the Sheriff of Harford County, or any other
Police Officer.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 423 and 428 of Article 13 of the Code of
Public Local Laws of Maryland, title "Harford County, "
sub-title "Liquors and Intoxicating Drinks" (Higin-
botham's 1942 Laws of Harford County; 421G and 421L
of the Code), be repealed and re-enacted, with amendments,
to read as follows;

421G. (423) "On Sale" licenses shall be granted only
to bona fide restaurants, incorporated clubs, and/or hotels.
"On Sale" licensees may serve beverages to bona fide guests
only, to be consumed at regular public tables, or, in the
case of hotels, may be served in guests' rooms; or such
licensees may also sell for consumption off the premises,
as provided in Section 421E. (421). "Off Sale" licenses
shall only be granted to proprietors of bona fide retail
stores selling food, drugs, or other similar commodities
and items as designated by the Liquor Control Board
under the provisions of Section 421D. (420).

The word "Hotel, " as used in this section, means any
establishment for the accommodation of the public
equipped with not less than ten bedrooms, containing not
less than one bed in each room, with sufficient covering
therefor, and equipped with a public dining room furnishing
not less than three meals per day, wherein the average daily
receipts from the hire of rooms and the sale of cooked and
prepared foods exceeds the receipts from the sale of "alco-
holic beverages. "

The word "Restaurant, " as used in this section, means
an establishment for the accommodation of the public,
fully equipped with a dining room and facilities for pre-
paring and serving regular meals, wherein the average
daily receipts from the sale of foods cooked or prepared
and served on the premises where the license is exercised.
