shall be set back not less than sixty (60) feet from the center of
any public highway, road, street or lane; (b) no building permit
for any commercial, industrial, or manufacturing structure
shall be issued unless the site proposed for the erection thereof
is adjacent to or in the near proximity of one or more other
existing commercial, industrial, or manufacturing structures.
The provisions of this section shall in no way be applicable
to that portion of Montgomery County lying within the Mary-
land-Washington Regional District.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.

CHAPTER 1046.
(House Bill 734)

AN ACT to repeal and re-enact, with amendments, Section
195 of the Code of Public Local Laws of Montgomery County
(1939 Edition), being Article 16 of the Code of Public Local
Laws of Maryland, title "Montgomery County", sub-title
"County Commissioners and Treasurer", sub-heading "Coun-
ty Treasurer", as amended by Chapter 358 of the Acts of
1943, relating to the appointment and compensation of an
additional Assistant Treasurer.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 195 of the Code of Public Local Laws of
Montgomery County (1939 Edition), being Article 16 of the
Code of Public Local Laws of Maryland, title "Montgomery
County", sub-title "County Commissioners and Treasurer",
sub-heading "County Treasurer", as amended by Chapter 358
of the Acts of 1943, be and the same is hereby repealed and
re-enacted, with amendments, to provide for the appointment
and compensation of an additional Assistant Treasurer and
all to read as follows:

195. The County Treasurer of Montgomery County shall
appoint Three (3) Assistant Treasurers at annual salaries
of Thirty-six Hundred Dollars ($3, 600. 00) and Twenty-four
