Article 23 of the Annotated Code of Maryland (1939 Edition),
title "Corporations, " sub-title "Public Service Commission, "
said new sections to be known as Sections 360A and 360B, to
follow immediately after Section 36'0 of said Article and to
read as follows:
360A. The term common carrier when used in this sub-
title shall include any person, firm, association or corporation
engaged in the operation of any motor vehicle (saving and
exception any motor vehicle of ten passengers or less capac-
ity) used for the transportation of passengers in charter and
contract service and not on regular schedule, and no common
carrier, on or after July 1st, 1945, shall operate any motor
vehicle for the transportation of passengers in charter and
contract service and not on regular schedule anywhere within
the State of Maryland unless such common carrier shall have
secured from the Public Service Commission a permit for each
motor vehicle to be used in such service and present the same
to the Department of Motor Vehicles at the time prescribed
by law for the making of applications for registration tags for
motor vehicles.
360B. A permit or permits for operation of motor vehicles
for transportation of passengers in charter and contract
service within the State of Maryland shall be granted by the
Public Service Commission of Maryland to any applicant, if
and upon investigation the Commission finds the applicant
was actively engaged as a bona fide bus operator on May 31st,
1942, and was continuously so engaged up to and including
March 1, 1945. The Commission may approve any such appli-
cation upon investigation, but no such application shall be de-
nied except after a full hearing thereon by the Commission,
provide, however, that any such application under this Section
must be filed with the Commission not later than June 1st,
1947.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1945.
