177. Any Acts or parts of Acts inconsistent herewith are
hereby repealed, but nothing herein shall be taken to inter-
fere with existing law for the protection or enforcement of
the collection of said assessments and the same shall be col-
lected in the same manner and to the same extent as taxes
are now collected.

178. (Ordinances—Penalties. ) The style of all ordinances
shall be "Be it enacted and ordained by the Mayor and Common
Council of Capitol Heights. " All actions and prosecution for the
violations of any rules, ordinances, regulations, shall be in-
stituted in the name of the Mayor and Common Council of
Capitol Heights against offending parties, and all fines re-
covered in such suits, actions or prosecutions for the breach
of any rule, ordinance or regulation of the corporation before
any Justice of the Peace of Prince George's County shall be
collected by the said Justice and paid over to the Mayor and
Common Council every month or oftener if required, and,
in the event of failure of any Justice to account for any of
said collection, he shall be fined and pay not less than One
Hundred ($100. 00) Dollars to be imposed and collected as
other fines imposed by the penal laws of this State.

179. (Supervisor. ) There may be appointed annually by
the Mayor and Common Council in said town, and in the
same manner and possessing the same qualifications as the
Mayor, one person as supervisor whose duty it shall be to
superintend the improvements of the town, and who shall
perform such other duties as the Mayor and Common Council
may prescribe, and he shall be allowed such compensation
as shall be fixed by them, and, in case of a vacancy in the
said office, a new appointment shall be made as in the case
of vacancies in the office of the Mayor.

180. (Gasoline Taxes. ) The County Commissioners} of
Prince George's County shall annually pay to the Mayor and
Common Council of Capitol Heights when and as collected
three-fourths (3/4) of all State gasoline tax of the said town,
which shall be expended by the Mayor and Common Council
exclusively in the repair and improvement of streets and roads
within the limits of said town.

181. (Town Contracts, Debt Limit. ) The Mayor and Com-
mon Council shall not expend, or contract to expend, in any
one fiscal year more money than the amount received from
taxes and other sources during that year, except from spe-
cial assessments as herein provided. The Mayor and Com-
mon Council may also from time to time borrow money for
the use of the town and issue therefor the bonds, notes or
