of Capitol Heights, such fees or other compensation as the
Mayor and Common Council shall set.
164. (Bailiff—Duty upon Making Arrest. ) The bailiff shall
perform such services as said Mayor and Common Council
shall direct. They shall arrest and carry before the Justice of
the Peace of Prince George's County persons found breaking
the peace or disturbing the quiet of said town, or violating any
of the ordinances of said town.
165. (Bailiff—Bond. ) The bailiff or bailiffs, before enter-
ing upon their duties, shall give bond to the Mayor and Com-
mon Council, in such penalty as shall be named by the Mayor
and Common Council, for their faithful performance of their
duties hereunder, and the said bond shall be recorded among
the records of said corporation.
166. (Oath of Town Officials. ) The Mayor, Councilmen,
Treasurer, Clerk, and Bailiffs before entering upon the duties
of their office shall take an oath that they will diligently and
faithfully, to the best of their judgment and ability, discharge
the duty of their office without favor, partiality, or prejudice
and to support the Constitution of the United States and of
the State of Maryland.
167. (Powers. ) The Mayor and Common Council of Capitol
Heights shall and are hereby granted authority to exercise all
power relating to municipal affairs and to pass ordinances and
take measures for the welfare, health, safety and improvement
of the town, and to exercise the Police power of the town. No
enumeration of powers in this or any law shall be deemed to
restrict the general grant of authority hereby conveyed, unless
expressly so stated in such law. The following shall be deemed
a part of the power conveyed upon the Mayor and Common
Council of Capitol Heights in this section.
168. (A) To levy, assess and collect taxes and to borrow
money within the limits provided by this Charter; to levy and
collect assessment for benefits conveyed.
(B) To make and maintain public improvements and to
acquire property within the corporate limits necessary for such
improvements.
(C) To have control over all the public roads, streets,
alleys and sidewalks within the corporate limits of the Town
of Capitol Heights, and provide for grading, mending and
perfecting the same.
' (D) To open, close and alter public roads, streets, alleys and
walks with the same power, and subject to the same limita-
