able to purchase trucks or other road building or repair
equipment it shall not be necessary for said County Commis-
sioners to advertise for bids on the same but they shall make
all due and reasonable effort to purchase the same at the low-
est possible price and, except in cases where equipment can be
obtained to the advantage of said county by purchasing at
public or forced sales, shall circularize local or other dealers
handling or selling the type of equipment needed, giving all
specifications and requirements, and said County Commission-
ers are hereby authorized to trade in old equipment on new
purchases, without asking for bids, whenever they deem the
same advisable or expedient. Provided, however, that said
County Commissioners shall not expend more than $25, 000. 00
for road machinery and equipment in any one year.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.

CHAPTER 1034.
(House Bill 592)

AN ACT to repeal Sections 137 to 185, inclusive, of the Code
of Public Local Laws of Prince George's County (1943
Edition), being Article 17 of the Code of Public Local Laws
of Maryland, title "Capitol Heights", and to enact in lieu
thereof 48 new sections to be known as Sections 137 to
185, inclusive, of said Article; said new sections defining
the boundaries of Capitol Heights, providing for its gov-
ernment by a Mayor and Common Council; and defining
the rights, powers, duties and obligations of said town and
said Mayor and Common Council including the right to
pass ordinances, levy and collect taxes, incur obligations,
maintain a police force, etc., and to employ the necessary
personnel to put into effect the provisions of said charter;
this last clause being descriptive of some of the powers, but
not in limitation of the other rights and powers granted
under said charter.
