1678 LAWS OF MARYLAND. [CH. 969

Article 73B of the Annotated Code of Maryland (1943
Supplement), title 'Tensions, " to be under sub-title "Em-
ployees of Municipal Corporations, " said new sections to
be known as Sections 17 to 24, inclusive, to follow imme-
diately after Section 16 of said Article, and to read as
follows:

17. (Definitions. ) The following words and phrases
as used in this sub-title, unless a different meaning is
plainly required by the context, shall have the following
meaning:

(1) "Municipal corporation" means county, incorpo-
rated town or municipality or other political sub-division
of the State.

(2) "Legislative body" means County Commissioners,
City Council, Town Council, President and Commissioners,
Burgess and Commissioners (or by whatever other name
the legislative body of any incorporated town, city or
municipality may be known) and the Board or Commis-
sion having authority or control over any other political
sub-division of the State.

18. (Municipal Employees Entitled to Membership in
Employees' Retirement System of State. ) On and after
January 1, 1946, any officer or employee of any municipal
corporation, except such officers and employees as are now
eligible to participate in a retirement system wholly or
partially maintained at the expense of a municipal cor-
poration, shall be entitled to membership in the Employees'
Retirement System of the State of Maryland as provided
by this Article and subsequent amendments thereto. Pro-
vided, however, that the officers and employees of any
municipal corporation shall not be included in said Em-
ployees' Retirement System of the State without the ap-
proval of the legislative body of any such municipal
corporation. Should the legislative body of any municipal
corporation on or after January 1, 1946, give its approval
to the participation of its officers and employees in the
said Employee's Retirement System of the State as here-
inabove provided, such employees shall be eligible to par-
ticipate in said Employees' Retirement System of the
State as specifically provided hereinafter for such em-
ployees.

19. (Membership in State System. ) (a) Membership
in the System for such officers and employees who are
admitted as provided in Section 18 of this Article shall be
optional with such officers and employees in the service
on the date the approval is given and any such officer or
