SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed by a yea any nay vote? supported by three-fifths
of all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date of
its passage.

CHAPTER 206.
(Senate Bill 83)

AN ACT to repeal and re-enact, with amendments, Section 22
of Article 89B of the Annotated Code of Maryland (1939
Edition), title "State Roads", making it unlawful for any
person to ride or to drive or operate a vehicle of any kind
upon the parking strips or parkways on dual highways.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 22 of Article 89B of the Annotated Code of
Maryland (1939 Edition), title "State Roads", be and it is
hereby repealed and re-enacted, with amendments, to read as
follows:

22. Any person who shall ride, drive or walk upon any new
roadbed, or new repairs of any roadbed, constructed or being
constructed by or under the supervision of the State Roads
Commission of Maryland before the same is opened for traffic,
and any person who shall ride or shall drive or operate a
vehicle of any kind upon the parking strips or center park-
way area on dual highways, unless authorized by said
Commission, and any person who shall remove any light
or guard set up for the purpose of closing said road or
any part thereof to traffic, and any person who shall
otherwise maliciously injure or damage in any manner any
highway built under the provisions of this Article, either in
the course of its construction or thereafter, or who shall other-
wise maliciously injure or damage any work, material or
structures used in connection therewith, shall be guilty of a
misdemeanor, and on conviction thereof, shall be fined not more
than one hundred dollars ($100) or be imprisoned not more
than three months, or in the discretion of the Court, may be
both fined and imprisoned as aforesaid, provided, however,
that nothing herein contained shall affect any special method
or manner of injury or damage, the prohibition or punishment
