1658 LAWS OF MARYLAND. [CH. 961

County Commissioners shall be retained and used for
county purposes, unless a different disposition is expressly
directed by statute; provided, however, that in Frederick
and Anne Arundel Counties, the County Commissioners
shall within a reasonable time, pay to the several incor-
porated municipalities of said counties 50% of all fines,
penalties and forfeitures received by them arising from
the violation of the ordinances of any of the said incor-
porated municipalities, and provided further that in
Washington, Worcester, Prince George's, St. Malay's,
Montgomery, Allegany, Calvert and Carroll Counties the
County Commissioners shall, within a reasonable time,
pay to the several incorporated municipalities of said
counties all fines, penalties and forfeitures received by
them arising from the violation of the ordinances of any
of the said incorporated municipalities; it being the inten-
tion that, although the fines, penalties and forfeitures re-
ceived by the County Commissioners are to be remitted to
the municipalities in the proportions named, the costs or
fees imposed and collected by said trial magistrates and
remitted to the County Commissioners, are to be retained
by said County Commissioners.

CHAPTER 961.
(Senate Bill 353)

AN ACT to repeal and re-enact, with amendments. Sections
11 and 13 of Article 78B of the Annotated Code of
Maryland (1939 Edition and 1943 Supplement), title
"Racing Commission", relating to the powers and duties
of the Racing Commission, limiting the maximum tax
on wagers at race meetings and providing for the
payment of breakage to the said Commission, and to
add a new Section to said Article, so titled, to be known
as Section 11 A, to follow immediately after Section 11
of said Article, providing that the Racing Commission
shall require licensees to deduct certain percentages of
the mutual pool as agents of the Commission, that the
Commission shall hold and deposit the funds so deducted
and authorize their use from time to time in the build-
ing or furnishing of substantial alterations, additions,
changes, improvements or repairs to racing plants by
the licensees making the deduction; providing the pow-
ers and duties of the Commission in respect to the
