Annotated Code of Maryland, title "Alcoholic Beverages",
sub-title "Beer and Light Wine License", providing for an
exemption for Howard County from the issuance of Class
D "On Sale", Beer and Light Wine Licenses.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That paragraph D of Section 5 of Article 2B of the 1943
Supplement to the Annotated Code of Maryland, title "Alco-
holic Beverages", sub-title "Beer and Light Wine License",
be and it is hereby repealed and re-enacted, with amendment,
to read as follows:
5.
D. (Beer and Light Wine License, Class D. (On Sale) —
Generally. ) Such a license shall be issued by the Clerk of the
Circuit Court of the County in which the place of business
is located, or by the Clerk of the Court of Common Pleas of
Baltimore City, if the place of business is located in said
City, and shall authorize the holder thereof to keep for sale
and to sell beer and light wines at retail, at the place therein
described, for. consumption on the premises or elsewhere, but
no such license shall be issued for any drug store. The annual
fee for such a license shall be Sixty Dollars ($60. 00), and shall
be payable to said Clerk, before any such license is issued, for
distribution as hereinafter provided. This section shall not
apply to Allegany, Anne Arundel, Calvert, Caroline, Dor-
chester, Frederick, Garrett, Harford, Howard, Kent, Queen
Anne's, St. Mary's, Somerset and Talbot Counties,
The hours during which the privileges conferred by such a
license may be exercised shall be from 6 A. M. to 12 o'clock
midnight, except in Baltimore City and Baltimore and Prince
George's County, where the hours shall be from 6 A. M. to
1 A. M. on the day following, and except in Prince George's
County where the closing hours shall not apply, but no holder
of such license shall be permitted to make any sale on the
day of any general, special or primary election.
SEC. 2. And be It further enacted. That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.
