declared to be the legislative intent that this Act would have
been adopted had such unconstitutional provisions not been
included therein.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.

AN ACT to enlarge the powers, authority and jurisdiction of
The Maryland-National Capital Park and Planning Com-
mission within that portion of the Maryland-Washington
Regional District lying in Montgomery County, so as to
provide for a Vice-Chairman of said Commission and fixing
his duties; creating a comprehensive public recreational
program with complete facilities, and providing for the
acquisition, maintenance and operation thereof within, and
under certain circumstances and conditions without, the
limits of said District; authorizing the issuance of bonds
for the foregoing purposes upon the full faith and credit of
the County guaranteeing the same, and providing for the use
of a two-fifths portion of the existing five per cent recreation
tax as the primary source for payment of the principal and
interest of such bonds; providing the method of determining
the form of and other details of the issuance and sale of such
bonds, and the total amount of bonds which may be out-
standing at any one time; authorizing the levying of a
general ad valorem tax upon all assessable property in the
County guaranteeing said bonds, to make up any deficiency
in the primary source of payment, of the amount necessary
to pay such principal and interest; providing for the manner
and method of supervision, control, inspection and policing
of said recreational facilities; ratifying and confirming the
existing system of permissive use of the, various recreational
facilities and providing for the employment of clerks and in-
spectors in connection therewith; providing for the establish-
ment of a merit system for the technical staff and employees
of said Commission and authorizing the adoption of rules and
