(1939 Edition), title "Elections", and all amendments thereof
be and it is hereby repealed, and that a new Article, to be
known as Article 33, title "Elections", be and it is hereby
enacted in lieu thereof, to read as follows:

ELECTION OFFICIALS

1. (a) The Governor biennially, by and with the advice and
consent of the Senate if in session, shall appoint in each county
of the State and in the City of Baltimore three persons who
shall constitute the Board of Supervisors of Elections of said
county or city, as the case may be. Said Supervisors shall be
residents and voters in their respective counties or in the City
of Baltimore, as the case may be, and two of them shall always
be selected from the two leading political parties of the State,
one from each of said parties.

(b) The Governor shall at the same time and in like manner
appoint to each Board two substitute Supervisors, one of whom
shall be of the same political party as the majority of the
Supervisors regularly constituting such Board, and the other
of whom shall be of the same political party as the minority
member of said regularly constituted Board. In the event of
the temporary or permanent incapacity from any cause of a
regular member of said Board, or in the event of a vacancy
on the regularly constituted Board, the substitute of the same
political p(arty as the regular member so incapacitated shall
serve in his place until such incapacity shall have terminated
or said vacancy shall have been filled as hereinafter provided
and while so serving shall have all the powers and authority
and be subject to all the duties imposed by law upon a regu-
larly appointed Supervisor.

(c) In case of any vacancy on any Board of Supervisors,
whether as to regular or substitute members thereof, by rea-
son of death, resignation or otherwise, occurring when the
legislature is not in session, the Governor shall appoint some
eligible person to fill such vacancy during the remainder of the
term of office of the person originally appointed; provided,
however, that if the latter was appointed as the representa-
tive of a political party, then only a person belonging to the
same political party shall be eligible as his successor,

(d) Before appointing such Supervisors of Elections, whether
as regular or substitute members of their respective Boards,
and before filling any vacancy as hereinbefore provided, the
Governor shall request the State Central Committees repre-
senting each of the two leading political parties of the State in
each county and in the City of Baltimore, as the case may be, to
designate at least four eligible candidates for such positions;
and the Governor shall appoint one of the persons so designated
